    Travel Mole reported this about Disney this morning. How do you guard against this type of thing?

    Disney faces lawsuit over dive-bombing bird injury

    In a scene reminiscent of a famous Hitchcock movie, a visitor to Walt Disney World is suing the park over injuries caused by an angry bird.

    The lawsuit claims Lisa Dixon was 'dive-bombed' by a migrating bird causing a 'traumatic brain injury'.

    The impact was akin to being struck by a baseball and Disney is at fault for not warning about the possible danger of migrating birds, it said.

    It gave her a 'false sense of security', lawyer Thomas Schmitt said.

    "If there's a company that's well-versed in safety, it should be Disney," Schmitt said.

    The 'attack' took place as Dixon was waiting on a dock by the Polynesian Resort to board a boat at Seven Seas Lagoon.

    The lawsuit calls out the company's failure to 'maintain the dock in a reasonably safe condition'.

    Disney said only it will 'respond to the allegations as appropriate in court'.

    The suit is claiming 'unspecified damages in excess of $15,000'.

    You never know the full story, but I guess the proof of the brain injury is the lawsuit

    That's called an "act of God" and Disney's attorneys will deal with it well, methinks.

    Absolute nonsense. You could get dive-bombed by a bird anywhere in Florida (or other parts of the country). Disney has no control over "migrating birds," or any other kind. So this one should get laughed out of court.

    A while ago when we were staying in San Diego there were a pair of birds protecting a nest in a tree in the gardens next to a main walkway between buildings. Every time anyone walked along the path the birds would attack. Needless to say the hotel soon got rid of the nest and the birds.

    But in this Disney case how do you mitigate against a migratory bird? The boat dock is covered so provides some protection. While I feel sorry for the lady I just can't see this successing. And as Disney are looking like they are going to defend the action they believe the same.

    I can't believe Disney let birds into the dome they have over the whole property, you know, the one they drop the rain out of when they want to sell ponchos.
    5 Trips to Florida, Christmas in LA, Disneyland Paris twice and odd days here and there.
